1. Scope and Definitions
1.1 scope These terms of use apply to the use of the service www.CommunityCorals.de (hereinafter referred to as “website”), which is operated by CommunityCorals – owner Dominique Deutzmann (hereinafter referred to as “CommunityCorals”), by the user (hereinafter referred to as “user”).

2. Services of CommunityCorals
2.1 Marketplace function CommunityCorals operates the website, an online marketplace for marine aquariums. The product range is strictly limited to marine aquariums. Users can offer (hereinafter referred to as "sellers") and purchase (hereinafter referred to as "buyers") the aforementioned animals, goods, and products on the website, as well as publish other content.
2.2 contractor CommunityCorals is – unless otherwise specifically indicated in the respective offer – neither the seller nor the buyer and is not a party to these contracts; these are concluded exclusively between the users of the website, namely the respective seller and buyer.
2.3 Shipping organization As part of the sales process, CommunityCorals organizes shipping. CommunityCorals enters into freight contracts with logistics companies (e.g., GO! Express, Jungle Express, UPS Express) in its own name. The seller commissions CommunityCorals to handle this organization by paying the shipping fees displayed during the order process.
2.4 Technical Payment Processing To process payments, CommunityCorals provides technical interfaces to licensed payment service providers (e.g., PayPal, Stripe). CommunityCorals does not accept funds as its own payment service provider, but rather uses the services of its licensed partners to technically allocate and forward payments on behalf of the seller within the scope of its collection authorization (see section 5.1). The user agrees to the use of these external payment service providers upon completion of the purchase.
3. Registration
3.1 Registration process Users have the option to register. Registration is contingent upon acceptance of these Terms of Use and the Privacy Policy. Upon confirmation of registration by CommunityCorals, a contract for the use of the website (hereinafter referred to as the "User Agreement") is concluded between CommunityCorals and the user. Registration of a minor requires the consent of their parent(s) or legal guardian(s). There is no entitlement to the conclusion of a User Agreement.
3.2 Access data The user must keep their login details, especially their chosen password, confidential. The user is obligated to inform CommunityCorals immediately if there is any indication that their login details have been used without authorization.can be determined.

4. Obligations of the user
The user is responsible for ensuring that the content he publishes does not infringe the rights of third parties and does not violate statutory regulations and/or morality.

(1) The user (seller) is solely responsible for ensuring that their offer, sale, and shipment of live animals complies with all applicable legal provisions. This includes, in particular, the Animal Welfare Act (TierSchG) and national and international species protection regulations (e.g., CITES, Federal Nature Conservation Act (BNatSchG), Federal Species Protection Ordinance (BArtSchV).
(2) Documentation requirements under species protection law (CITES):
a. Offering animals listed in Annex A of EU Regulation (EC) No. 338/97 on the protection of wildlife species (strictly protected species) is strictly prohibited unless the seller possesses a valid EU marketing certificate (yellow CITES certificate) for the specific animal. The advertisement must clearly and unprompted state that the original certificate is available.
b. For animals listed in Annex B of the EU Wildlife Trade RegulationFor protected species, the seller must have complete and plausible proof of origin and be able to demonstrate the animal's legal provenance at any time. (See also FAQ)
(3) Permit requirementSection 11 of the Animal Welfare Act: If a sellerAnyone who trades in vertebrates commercially or breeds them commercially, confirms by posting the advertisement that they possess the mandatory permit pursuant to Section 11 Paragraph 1 Sentence 1 Number 8 of the Animal Welfare Act from the responsible veterinary authority.to order the veterinary office.
(4) No obligation to review, but right to remove: As an intermediary service, CommunityCorals is not obligated to proactively conduct a legal review of advertisements. However, CommunityCorals reserves the right to remove advertisements if there is reasonable suspicion of a violation of these obligations or applicable law – in particular in the case of missing or implausible information.CITES documents – to be removed immediately and without warning (see also point 6).
5. Sales via the website
5.1 Debt collection trust relationship The seller engages CommunityCorals, within the framework of a debt collection trust agreement, to receive and forward payments and authorizes CommunityCorals to collect the respective fees. CommunityCorals acts solely as a technical payment processor and trustee. CommunityCorals does not provide any payment services requiring authorization under the German Payment Services Supervision Act (ZAG), but rather operates purely as a technical and organizational processor, utilizing licensed payment service providers. Amounts credited to CommunityCorals are forwarded to the seller, less any applicable fees. CommunityCorals does not guarantee the buyer's creditworthiness or the long-term reliability of payments processed by the payment service provider (e.g., PayPal).
5.2 Consumer protection obligations If a seller is acting in the course of their commercial or self-employed professional activity, they are obligated to provide their buyers with the legally required consumer protection information and to inform them about the existence or non-existence of the statutory right of withdrawal. CommunityCorals offers sellers the use of General Terms and Conditions for processing sales via the website. However, CommunityCorals assumes no liability whatsoever in this regard; the use of the General Terms and Conditions for sales via the website, whether in their original or modified form, is voluntary and at the seller's own risk.
5.3 Shipping and Liability
(1) The risk of accidental loss or damage to the goods (transport risk) is governed by the following legal provisions: a) If the seller is acting as a private individual, the shipping risk passes to the buyer as soon as the goods have been handed over to the logistics company. b) If the seller is acting as a business, the seller bears the shipping risk until the goods are handed over to the buyer (consumer goods purchase). The shipping fees charged by CommunityCorals include freight costs and a service fee for the organization.
(2) The seller is solely responsible for the proper, animal-welfare-compliant, and transport-safe packaging of the goods. They must strictly adhere to the packaging guidelines of the respective logistics partner. (3) Assignment of claims: In the event of loss, damage, or delay in delivery, CommunityCorals hereby assigns to the seller all claims for damages that CommunityCorals may have against the commissioned logistics company under the freight contract. The seller accepts this assignment.
(4) By virtue of this assignment, the seller will claim damages directly from the logistics company. CommunityCorals' own liability for transport damage is excluded, unless CommunityCorals is at fault for its own selection of the logistics partner or for intent/gross negligence.
5.4 Reservation of payment and chargebacks
(1) CommunityCorals’ obligation to pay the purchase price to the seller is subject to the condition precedent that the payment amount is finally and irrevocably available to CommunityCorals.
(2) If the buyer uses buyer protection procedures of payment service providers (in particular PayPal buyer protection) and this leads to a chargeback, blocking or freezing of the payment amount in CommunityCorals' account, CommunityCorals' obligation to pay the seller the amount of the chargeback shall cease.
(3) This applies regardless of whether the payment service provider's (e.g., PayPal) decision is correct under German sales law or not. The seller acknowledges that the risk of a decision by the payment service provider against the seller (e.g., based on the payment service provider's terms and conditions) is borne solely by the seller in the relationship between the seller and CommunityCorals.
(4) If the amount has already been paid out and a subsequent chargeback is issued by the payment service provider, the seller is obliged to reimburse CommunityCorals. CommunityCorals is entitled to offset this reimbursement claim against any outstanding balances of the seller.
(5) The seller is obligated to actively cooperate in the resolution of disputes (e.g., PayPal buyer protection claims). They must provide CommunityCorals with all evidence necessary for their defense (e.g., proof of posting, delivery confirmation with time stamp, photos, correspondence) immediately, but no later than 24 hours after being requested to do so. If the seller fails to comply with this obligation to cooperate, they bear sole responsibility for any resulting negative outcome of the dispute proceedings.
5.5 Legal action against the buyer CommunityCorals is not a party to the purchase agreement. In the event of a chargeback or a buyer protection claim, the seller's original claim for the purchase price against the buyer is reinstated. The enforcement of this claim is the sole responsibility of the seller. CommunityCorals does not undertake any legal review or pursue the claim out of court or in court and is neither obligated nor authorized to do so.
5.6 Origin information The seller is obligated to accurately state the origin of the animals when listing them. The origin categories are "Aquarium-bred offspring," "Farm-bred," "Fish tank dismantled," and "Wild-caught." Proven deception will result in immediate and permanent exclusion from selling.
5.7 Pricing and Competitiveness
(1) The seller is free to set his selling prices.
(2) CommunityCorals aims to offer buyers an attractive and competitive selection. The seller is aware that the asking price is a key factor in the presentation and discoverability of their items on the marketplace. CommunityCorals reserves the right to restrict the visibility, lower the ranking, or exclude from marketing activities (e.g., newsletters, homepage) any listings that appear disproportionately high compared to the market price level (including the seller's own sales channels).
5.8 Advertising ban The seller agrees not to use CommunityCorals as an advertising platform for their own webshops or other non-store-bound sales channels.
5.9 Prohibition of circumvention Users agree not to contact other CommunityCorals users with the intention of buying or selling items outside of CommunityCorals. Such offers harm other CommunityCorals users and pose a potential fraud risk to both buyers and sellers. We reserve the right to block any users involved.
6. Closure
If a user violates their obligations under sections 4 and 5, CommunityCorals has the following rights in particular: deletion of the respective offer; blocking of the user. The right to modify content remains unaffected.
7. Contract duration, termination
7.1 Contract duration The term of the user agreement is unlimited.
7.2 Termination The user agreement can be terminated by either party to CommunityCorals with 14 days' notice to the end of the month.
8. Fees
8.1 Commission obligation CommunityCorals charges the seller fees for successful listings; if a purchase is completed via the website, the seller is obliged to pay CommunityCorals commission fees according to the current fee schedule (https://www.communitycorals.de/verkaufen/) to pay.
8.2 due date The respective fees for each purchase are due immediately and will be retained by CommunityCorals during payment processing.
8.3 Fee Change CommunityCorals reserves the right to change fees and sales commissions at any time. Users will be notified of price changes in a timely manner before they take effect.
9. Rights of use
The user grants CommunityCorals all non-exclusive rights to use the posted content that are unlimited in terms of location, time and content. In particular, CommunityCorals is entitled to reproduce, distribute, edit and make the content publicly accessible. 11.2 Unlimited liability CommunityCorals is liable without limitation for damages resulting from injury to life, body or health, as well as for damages based on intent or gross negligence on the part of CommunityCorals or one of its legal representatives or agents, and for damages due to non-compliance with a guarantee or warranted characteristic given by CommunityCorals or due to fraudulently concealed defects.
11.3 Slight negligence CommunityCorals is liable, limited to compensation for foreseeable damages typical of this type of contract, for damages resulting from a slightly negligent breach of essential contractual obligations by itself or one of its legal representatives or agents. Essential contractual obligations are those obligations whose fulfillment is essential for the proper performance of the contract and on whose compliance the other party may regularly rely.
11.4 Disclaimer of Liability CommunityCorals accepts no further liability.
11.5 Product Liability Act Liability under the Product Liability Act remains unaffected.
12. Exemption
The user shall indemnify CommunityCorals against all claims that other users or third parties may have against CommunityCorals due to infringement of their rights.to make it end. Similarly, CommunityCorals cannot determine the validity of buyer complaints.

6. Transfer of risk The risk of accidental loss (e.g., loss or death of the animal during transport) is transferred as follows:

Sale by entrepreneur: The risk only passes to the buyer when the goods have actually been delivered to the buyer (§ 474 BGB).
7. terms of payment

Payment via PayPal: The buyer pays directly via their PayPal account. After submitting the order, the buyer is redirected to PayPal and authorizes the payment there. 8. Warranty and Live Arrival (DOA)

(2) Special feature of live animals: The seller guarantees that the animal is alive and healthy at the time of transfer of risk (handover to the buyer). Since live corals and invertebrates are extremely sensitive to water parameters and acclimatization, the death of an animal after handover in the buyer's aquarium does not generally constitute a defect, but rather falls within the buyer's sphere of risk.
