  1. Scope and Definitions

1.1 For using the offer www.CommunityCorals.de (hereinafter referred to as "website"), which is operated by CommunityCorals - owner Dominique Deutzmann (hereinafter referred to as "CommunityCorals"), by the user (hereinafter referred to as "user") these terms of use apply.

1.2 Contradictory, deviating or supplementary terms of use of the user shall not become part of the contract unless CommunityCorals expressly agrees to their validity. These terms of use also apply if CommunityCorals unconditionally performs services in the knowledge of conflicting or deviating terms of the user.

  1. Services provided by CommunityCorals

2.1 CommunityCorals operates the website, an online marketplace for seawater aquaristics. The range of products is strictly limited to saltwater aquaristics. Users can offer the above-mentioned animals, goods and products on the website (users in this capacity hereinafter referred to as “seller”) and purchase (users in this capacity hereinafter referred to as “buyer”) and publish other content.

2.2 CommunityCorals itself is neither a seller nor a buyer and is not a contractual partner of these contracts, unless this is specifically indicated in the respective offer; these are concluded exclusively between the users of the website, namely the respective seller and buyer.

2.3 In the course of the sales process, CommunityCorals organizes the shipping. The seller commissions CommunityCorals to pick up the goods on behalf of the seller and deliver them to the customer according to the order.

2.4 For payment processing, CommunityCorals, as a payment instrument, offers a personalized procedure that allows an amount of money to be accepted on behalf of the payee and made available to him. For this purpose, database-based software is used that manages at product level which amounts of money have been received for which payee, which amounts have been reimbursed, if applicable, and which amounts are to be made available. With this specially developed payment instrument, the user has full transparency about the underlying financial transfer business at all times. The user agrees to the use of this method both when offering goods and when making a purchase. The use of the payment instrument between the payment service user and the payment service provider is therefore deemed to have been agreed with the conclusion of the purchase.

  1. Registration

3.1 The user has the option to register. Registration takes place by agreeing to these terms of use and the data protection declaration. With confirmation of the registration by CommunityCorals, a contract between CommunityCorals and the user for the use of the website (hereinafter referred to as "user contract") is concluded. The registration of a minor user requires the consent of the legal guardian. There is no right to conclude a usage contract.

3.2 The user must keep his access data, in particular the password he has chosen, secret. The user is obliged to inform CommunityCorals immediately if there are indications that the access data can be used without authorization.

3.3 If the user does not register, various functions of the website (e.g. comment function) are only possible by providing their name and email address and, if necessary, by confirming the terms of use or the cancellation policy (e.g. when purchasing via the website).

  1. User Obligations

The user is responsible for ensuring that the content he publishes does not infringe the rights of third parties and does not violate statutory regulations and/or morality.

5.1 The seller commissions CommunityCorals with the payment processing in the event of a sale and authorizes CommunityCorals to collect the respective remuneration.

5.2 If a seller is active in the exercise of his commercial or self-employed professional activity, he is obliged to provide his buyers with the legally required consumer protection information and to instruct them about the existence or non-existence of the statutory right of withdrawal. CommunityCorals offers sellers the use of general terms and conditions for the processing of sales through the website. However, CommunityCorals assumes no liability in this respect; the use of the terms and conditions for a sale via the website in unchanged or modified form is voluntary and takes place at your own risk.

5.3 By default, each offer contains several shipping options. Depending on the seller membership, this includes the shipping partner of CommunityCorals or the shipping partner of the respective seller. The buyer can choose the respective shipping option for each purchase. The seller must expressly comply with the respective transport conditions of the logistics partner in the currently valid version (currently: Jungle Express. The seller indemnifies CommunityCorals against all liability with regard to the transport. The applicable costs are negotiated by CommunityCorals and retained by CommunityCorals in the course of payment processing. 5.4 If the buyer activates PayPal buyer protection when making a payment via Paypal for reasons for which the seller is responsible, the seller shall indemnify CommunityCorals against any claims.

5.5 The seller undertakes to correctly state the origin of the animals when creating the article. The species of origin are “aquarium-grown offspring”, “farm offspring”, “tank resolution”, and “wild-caught”. Demonstrable fraud leads to immediate and permanent exclusion from the sale. 

5.6 The seller undertakes to ensure that the CommunityCorals The item price offered, including shipping, is the same as or lower than the corresponding price at which the item is offered on other non-store-related sales channels.

5.7 The seller undertakes not to use CommunityCorals as an advertising platform for their own web shops or other sales channels not linked to a retail store.

5.8. With the aim of closing the sale, CommunityCorals is granted a leeway for a discount of up to 5% as a price reduction on the goods offered by the seller within the framework of the commercial agent regulation. 

5.9 The user undertakes not to contact other CommunityCorals users with the aim of buying or selling items outside of CommunityCorals. Offers of this type harm other users of CommunityCorals and pose a potential risk of fraud for buyers and sellers. We reserve the right to block the users involved.

  1. blocking

Insofar as a user violates the obligations incumbent on him in accordance with Sections 4 and 5, CommunityCorals has the following rights in particular:

  • Deletion of the respective offer
  • blocking of the user.

The right to change content remains unaffected.

  1. Contract term, termination

7.1 The term of the contract of use is unlimited.

7.2 The contract of use can be terminated by either party to CommunityCoral with a notice period of 14 days to the end of the month.

8.1 CommunityCorals charges the seller for the successful listing; when a purchase is completed through the website, the seller is liable to CommunityCorals commission fees according to the current fee table (https://www.communitycorals.de/verkaufen/) to pay.

8.2 The respective fees per purchase are due for payment immediately and will be retained by CommunityCorals in the course of payment processing.

8.3 CommunityCorals may change the fees and sales commissions at any time. Price changes will be communicated to users in good time before they come into effect.

  1. use rights

The user grants CommunityCorals all non-exclusive rights to use the posted content that are unlimited in terms of location, time and content. In particular, CommunityCorals is entitled to reproduce, distribute, edit and make the content publicly accessible. The provider has the right to move posts within its website and to connect them to other content.

  1. Availability of the offer

CommunityCorals strives for high availability of the website. However, the user is aware that the following times in particular can limit the availability of the database:

– Times of non-availability, which are based on disruptions to the Internet that CommunityCorals cannot influence or on other circumstances for which CommunityCorals is not responsible, in particular force majeure;

– Periods of unavailability due to planned maintenance work on the website.

  1. Liability

11.1 CommunityCorals is liable, regardless of the legal reason, within the framework of the statutory provisions only in accordance with the following clauses 11.2 to 11.4.

11.2 CommunityCorals is liable without limitation for damages resulting from injury to life, limb or health as well as for damages based on intent or gross negligence on the part of CommunityCorals or one of its legal representatives or vicarious agents, as well as for damages due to non-compliance with a guarantee given by CommunityCorals or guaranteed property or because of fraudulently concealed defects.

11.3 CommunityCorals is liable, limited to compensation for the foreseeable damage typical for the contract, for such damage that is based on a slightly negligent breach of essential contractual obligations by it or one of its legal representatives or vicarious agents. Essential contractual obligations are obligations the fulfillment of which is essential for the proper execution of the contract and on the compliance with which the contractual partner may regularly rely.

11.4 Liability in accordance with the Product Liability Act remains unaffected.

  1. exemption

The user exempts CommunityCorals from all claims that other users or third parties assert against CommunityCorals due to violation of their rights. In particular, this also includes the costs of the necessary legal defense of CommunityCorals including all court and attorney fees in the statutory amount. The above does not apply if the user is not responsible for the infringement. In any case, the user is obliged to inform CommunityCorals immediately, truthfully and fully in the event of a claim by third parties in order to enable a complete examination of the claims.

  1. Data Protection, Secrecy

13.1 The user is informed that CommunityCorals collects, processes and uses personal inventory and usage data in machine-readable form within the scope of the purpose of the contractual relationship. All personal information will be handled confidentially.

13.2 The contracting parties undertake to treat confidentially any information from the other party that becomes known to them in the course of the execution of the contract.

  1. Online Dispute Resolution

As an online company, we are obliged to refer you as a consumer to the European Commission's platform for online dispute resolution (OS platform). This OS platform can be reached via the following link: https://webgate.ec.europa.eu/odr. However, we do not take part in a dispute settlement procedure before a consumer arbitration board.

15.1 You can view these Terms of Use at www.CommunityCorals.de. You can also print out or save this document by using the usual function of your Internet service program (=browser: usually “File” -> “Save as”). You can also download and archive this document in PDF form by HERE click. To open the PDF file you need the free program Adobe Reader (at www.adobe.de) or comparable programs that can handle the PDF format.

15.2 Place of fulfillment is Krefeld. The exclusive place of jurisdiction for disputes with merchants, legal entities under public law or special funds under public law arising from contracts is also Krefeld.

15.3 The law of the Federal Republic of Germany shall apply exclusively to all disputes in connection with the use of the website, regardless of the legal reason, to the exclusion of all provisions of the conflict of law provisions that refer to another legal system. The application of the UN sales law is excluded.

Principle of communication between CommunityCorals users

CommunityCorals users can send messages to each other through the inquiry and support function. We expressly encourage our users to communicate openly with each other. However, you may not misuse the CommunityCorals messaging systems and use them for any purpose other than buying and selling on CommunityCorals.

To keep everyone in our community feeling safe, there are policies and guidelines that govern communication at CommunityCorals.

It is strictly forbidden to abuse the CommunityCorals message systems:

  • to send spam messages
  • to offer purchases or sales of items outside of CommunityCorals
  • to spread threats or messages with offensive, vulgar or hateful content
  • to exchange personal information (other than names), such as email addresses, phone numbers, or other contact information. (This applies to the request function. Exchange is permitted via support tickets)
  • to send viruses, malware or other program code created with malicious intent

CommunityCorals reserves the right to review messages sent through the CommunityCorals messaging systems; where appropriate, this may delay or block the transmission. This is how we protect against fraudulent or suspicious activity or violations of the CommunityCorals Terms of Service. Violating this can lead to the permanent blocking of the user accounts involved.

Guidelines for evaluating a seller

Buyers with a valid order have the opportunity to submit a seller rating at CommunityCorals. Reviews serve to provide other interested parties with information about the purchasing experience in order to make the purchasing experience easier.

The CommunityCorals 5-star rating system allows customers to give a rating from 1-star (lowest rating) to 5-star (highest rating) in the areas of packaging, quality and service. This is intended to ensure the highest possible level of transparency about the purchasing experience.

As a marketplace for breeding corals, we are aware that for some customers, particularly in the coral shipping sector, there is concern about the quality of the corals and the safe arrival of the animals. We think that with the help of the 5-star rating system we protect our users from unpleasant surprises and thus ensure a good user experience throughout the entire purchasing process.

As a marketplace, we also have a responsibility to protect our sellers from possible unjustified actions. For this reason, customers follow the following guidelines for leaving a negative review:

  • If damaged corals were delivered, a picture of the damage must be taken on the day of arrival and provided to the seller.
  • The seller must be informed of any damage on the same day in order to have the opportunity to comment and make improvements.
  • A review must not be used as a means of pressure to get the seller to pay.
  • The valuation must relate to matters within the seller's control. (Excludes shipping providers, CommunityCorals or third parties)

CommunityCorals will only remove a review if we determine that it violates the above guidelines.

If you believe a review violates our guidelines, please leave it in**@co*************.de report. Reviews that are negative but adhere to CommunityCorals guidelines will be not removed. However, the seller has the opportunity to respond to the review here.

CommunityCorals does not have the authority to delete reviews that do not comply with our policies, even if a seller disagrees with the buyer's assessment of the item or service received. The Platform is unable to assess the accuracy of a buyer's statements regarding aspects such as quality, packaging, item description or communication. Likewise, CommunityCorals cannot determine how legitimate buyers' complaints are.

In such cases, we recommend that sellers continue to do their best to provide good service and focus on getting more positive reviews in the future.

  1. Scope, registration

1.1 For a Purchase through the Offer www.CommunityCorals.de (hereinafter referred to as “website”), which is operated by CommunityCorals – owner Dominique Deutzmann (hereinafter referred to as “CommunityCorals”), by the buyer (hereinafter referred to as “buyer”) these General Terms and Conditions apply. If and to the extent that the seller makes his own conditions in the "General Terms and Conditions" tab the basis of the sale, these conditions shall take precedence.

2.1 CommunityCorals itself is neither a seller nor a buyer and is not a contractual partner of these contracts, unless this is specifically indicated in the respective offer; these are concluded exclusively between the users of the website, namely the respective seller and buyer. The provider of the respective offer is exclusively the respective seller.

2.2 The presentation of animals, goods or products on the website does not constitute a binding offer to conclude a purchase contract. The buyer is only asked to submit an offer by placing an order.

2.3 If one or more products are selected, they are placed in a virtual shopping cart, where the selected products can be viewed and their number changed or the products removed. By clicking the "Checkout" button, the buyer is prompted to enter the information relevant to shipping and to select a payment method. Before completing the order, you will be shown a summary of all the information relevant to the order. By clicking the "buy now" button, the ordering process is completed and the order is sent.

2.4 By sending the order on the website, the buyer submits a binding offer, which is aimed at the conclusion of a purchase contract for the goods contained in the shopping cart with the respective seller. By sending the order, the buyer also accepts these terms and conditions as solely relevant for the corresponding legal relationship.

2.5 The buyer will receive confirmation of receipt of the order by sending a confirmation e-mail. This order confirmation does not yet represent acceptance of the contract offer by the seller. It merely serves to inform the buyer that the order has been received by the seller. The declaration of acceptance of the contract offer is usually made within a few days by the delivery of the goods or an express declaration of acceptance.

  1. Prices

The prices listed for the products at the time the order is placed apply to orders. All prices quoted are gross prices and include - where applicable - the German statutory value added tax. They do not include shipping costs. Additional costs will be charged separately.

4 Terms of Delivery, Shipping

4.1 Shipping costs will be charged for delivery unless the buyer decides to collect the goods himself. You can find the shipping costs HERE

4.2 The seller is entitled to partial deliveries and partial services. The seller bears the resulting costs.

4.3 If a buyer does not take delivery of the goods, the seller may, after a period of 2 weeks, sell the goods to a third party and hold the original buyer liable for any loss incurred.

4.4 Despite careful stocking, it can happen that individual items are no longer available. The seller can therefore not guarantee delivery. The following applies: Only while stocks last. If the goods cannot be delivered due to force majeure or product discontinuation, or if the seller is unable to procure the ordered products under reasonable conditions and if these circumstances only occur after the conclusion of the contract and are not the responsibility of the seller, the seller will be released from the delivery obligation. If events occur that make delivery significantly more difficult or impossible for the seller - such as strikes, lockouts, official orders or the like - the seller is not responsible for delays, even in the case of bindingly agreed deadlines and dates.

4.5 If the buyer makes use of his right of withdrawal, he shall bear the direct costs of the return.

  1. Transfer of risk

With regard to the transfer of risk (corresponds to the risk of accidental loss and accidental deterioration), the statutory regulations apply:

– In the case of shipment, the risk passes to the buyer as soon as the seller has delivered the item to the person designated to carry out the shipment. (§ 447 paragraph 1 BGB)

– If the buyer is a consumer and the seller is an entrepreneur, Section 447 (1) of the German Civil Code does not generally apply; instead, the seller is liable until the purchased item is handed over to the buyer. (Section 474 (4))

  1. Terms of payment

The payment methods prepayment and Paypal are offered for orders. We reserve the right to exclude certain payment methods in individual cases.

Payment by Paypal

The buyer pays directly via their PayPal account. After sending the order, the buyer is forwarded to PayPal and releases the order value there. As soon as the CommunityCorals PayPal account has been informed of the buyer's authorization, the item will be shipped, depending on the delivery time specified for the item. When the goods are shipped, the buyer's PayPal account will be debited with the actual invoice amount.

  1. claims in the event of defects

The statutory liability for defects applies.

Complaints about dead animals:

– Claims for defects must be reported to the seller within 4 hours of arrival. The seller can be contacted via “My Account” – “Orders” – “Support” via support ticket.

– Send the seller a photo of the dead animal in the closed transport container and also a photo without the transport container showing the animal.

– If the complaint is received late, the seller reserves the right not to recognize the defect. 

- If the claim is valid, the seller can provide a replacement or initiate a refund through CommunityCorals.

Important note: If you have any known intolerances, you should definitely consult your doctor. 

  1. Retention of title

In the case of consumers, we reserve ownership of the purchased item until the invoice amount has been paid in full. If you are an entrepreneur exercising your commercial or self-employed professional activity, a legal entity under public law or a special fund under public law, we reserve title to the purchased item until all outstanding claims from the business relationship with the customer have been settled. The corresponding security rights are transferable to third parties.

Essential contractual obligations are obligations the fulfillment of which is essential for the proper execution of the contract and on the compliance with which the contractual partner may regularly rely.

9.4 Liability in accordance with the Product Liability Act remains unaffected.

10.2 The contracting parties undertake to treat confidentially any information from the other party that becomes known to them in the course of the execution of the contract.

  1. Mandatory information for consumers

11.1 The seller grants buyers who are consumers a right of cancellation in accordance with the following cancellation policy.

A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity (§ 13 BGB).

You have the right to withdraw from this contract within fourteen days without the need to state any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier takes possession of the goods or, in the case of partial deliveries, the last delivery. In order to exercise your right of withdrawal, you must contact us (Community Corals – Owner Dominique Deutzmann, Urfeystr.32, 47803 Krefeld, In**@co****************.de) inform you of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email).

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of withdrawal

If you withdraw from this contract, we will reimburse all payments we have received from you, including the costs of supply (with the exception of the additional costs arising from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), and repay immediately latest within fourteen days from the date on which the notification has been received about your cancellation of this contract with us. For this repayment, we use the same method of payment that you used in the original transaction, unless you explicitly agreed otherwise; in any case you will be charged fees for this repayment.

You will bear the direct cost of returning the goods.
